Terms of Service

These Terms of Service (“Terms”) govern your use of services provided by Ecoast Pool Service (“Ecoast,” “we,” “us,” or “our”). By signing up for service, accepting a quote, or continuing service after the effective date above, you (“Customer,” “you”) agree to these Terms.
1. Acceptance of Terms
You accept these Terms by any of the following:
- clicking “I agree” or a similar acceptance mechanism on our website or quoting tool;
- signing a service agreement (electronic or physical);
- making any payment to Ecoast for services; or
- continuing to receive service after the Effective Date above following written notice (including email) of these Terms.
If you do not agree to these Terms, you must cancel service before your next billing date.
2. Services
Ecoast provides residential and commercial swimming pool and spa services in New Jersey. Services may include weekly maintenance, chemical balancing, equipment inspection, opening/closing, green-to-clean restoration, salt cell servicing, winterization, spa drain and refill, and other services as set forth in your service agreement or quote.
3. Contract Term and Auto-Renewal
Service agreements run for the term stated in your agreement (typically a seasonal or annual term). Unless cancelled in accordance with Section 7, agreements automatically renew for successive terms of equal length at our then-current rates. We will notify you of any rate change at least 30 days before the renewal date.
4. Pricing and Payment Terms
(a) Pricing. Pricing is set forth in your signed agreement or accepted quote. Pricing may be adjusted annually with at least 30 days' written notice.
(b) Recurring Billing Authorization. By providing a payment method and accepting these Terms, you authorize Ecoast and its payment processor (Stripe) to automatically charge your designated payment method on a recurring basis for services rendered, until you cancel in accordance with Section 7.
- Monthly customers are charged once per month. Year 1 monthly amounts may be higher than Year 2 because we collect the full annual contract value across the months remaining in the current calendar year. Beginning January 1 each year, monthly amounts reset to the standard 12-month spread of the then-current annual rate.
- Annual (paid-in-full) customers are charged once per year on the anniversary of their initial payment. Annual customers receive a 5% discount in exchange for paying the full year upfront, and this discount continues to apply each renewal year. By selecting paid-in-full, you authorize Ecoast to automatically charge your saved payment method on each anniversary date for the next year of service at the then-current annual rate (with the 5% paid-in-full discount applied). It is your responsibility to notify Ecoast in writing if you wish to cancel before the next anniversary charge — see Section 7(a) for the required cancellation window.
You authorize us to update your card information through automatic card-updater services if your card expires or is reissued.
(c) Card-on-File. Ecoast does not store full payment card information on our systems. Payment information is collected, stored, and processed by Stripe under Stripe's terms and privacy policy.
(d) Failed Payments. If a payment fails, we will attempt re-collection. A $25 NSF/declined-payment fee may be assessed for each failed transaction. Service may be suspended after 10 days of non-payment.
(e) Late Fees. Invoices not paid within 15 days of the due date are subject to a 1.5% monthly late fee (18% annual), or the maximum permitted by New Jersey law, whichever is lower.
(f) Sales Tax. All applicable New Jersey sales taxes will be added to invoices where required by law.
5. Custom Quotes and One-Time Services
Quotes for custom or one-time services (e.g., green-to-clean, equipment installation, repairs) are valid for 30 days from the date issued. Acceptance of a quote constitutes acceptance of these Terms with respect to that work. A deposit may be required for custom work, as stated in the quote.
(a) Remaining balance — due upon receipt. When a deposit is collected, the remaining balance for the work is invoiced separately once the work is complete and is due upon receipt of that invoice. New Jersey Sales Tax is charged on each payment’s portion (the deposit at acceptance and the balance at completion), not twice on the same amount.
(b) Authorization to charge the card on file. By accepting a quote and providing a payment method, you authorize Ecoast Pool Service and its payment processor (Stripe) to charge your saved payment method for the remaining balance (including applicable Sales Tax) when the balance invoice is issued. You will receive an itemized invoice for the balance before or at the time any such charge is processed.
6. Scope and Exclusions
The scope of services covered by your recurring agreement is limited to what is specifically listed in your agreement. Items not included (e.g., equipment repair, parts, drain-and-refill, acid wash, leak detection) will be quoted separately. We will notify you in advance before performing work that exceeds the scope of your agreement.
7. Cancellation
(a) Customer Cancellation. You may cancel recurring service at any time by providing written notice to support@ecoastpoolservice.com at least 30 days before your next billing date (for monthly customers) or before your next anniversary renewal date (for annual paid-in-full customers). Cancellation requests received less than 30 days before the next charge will take effect after that charge has processed; no refunds are issued for the period already paid.
(b) Mid-Term Cancellation Fee. Cancellation of an annual or seasonal agreement before the end of the term may be subject to an early-termination fee equal to 25% of the remaining contract value, as stated in your agreement.
(c) Ecoast Cancellation. We may cancel service for non-payment, unsafe site conditions, or breach of these Terms with 7 days' written notice. We may cancel without cause at the end of any billing period with 30 days' written notice.
8. Refunds and Disputes
(a) Refunds. Refunds for prepaid services will be issued pro-rata for services not yet rendered, less any applicable cancellation fee.
(b) Dispute Process. If you dispute a charge, you agree to contact Ecoast at support@ecoastpoolservice.com to resolve the dispute before initiating a chargeback with your card issuer. Chargebacks initiated without first contacting us may result in service termination and collection costs.
9. Access and Site Conditions
You agree to provide safe, unobstructed access to the pool/spa area on scheduled service days. If our technician cannot access the site or the site is unsafe (e.g., aggressive pets, hazardous conditions, severe weather), we may skip the service and you remain responsible for the full service charge. We will notify you of skipped service.
10. Weather and Force Majeure
We do not service in unsafe weather conditions (lightning, severe storms, freezing temperatures). Skipped services due to weather will be rescheduled at our reasonable discretion. We are not liable for delays or non-performance due to events beyond our reasonable control, including weather, natural disaster, supply shortages, labor disputes, or governmental action.
11. Equipment
(a) Customer Equipment. Pool equipment (pumps, filters, heaters, automation, salt cells, etc.) is owned and maintained by you. We will inspect equipment as part of routine service and notify you of issues.
(b) Repairs. Equipment repairs are not included in recurring service unless specified in your agreement. We will provide a separate quote before performing repairs above $150 unless you have pre-authorized us to perform repairs up to a stated dollar limit.
12. Chemicals and Water Treatment
(a) Chemical Use. We use commercial-grade pool chemicals (chlorine, acid, salt, algaecide, etc.). All chemicals are handled and applied in accordance with manufacturer guidelines and applicable safety regulations.
(b) Customer Responsibilities. Pool water must be at the proper level for service. Significant water-chemistry imbalance caused by customer activity (party loads, untreated fill water, draining) may require additional chemicals invoiced separately.
(c) Chemical Exposure. Pool water may contain residual sanitizer for several hours after treatment. Keep pets, children, and persons with chemical sensitivities clear of the pool area for at least 4 hours after service or per the applied chemical's safety data sheet.
13. Green-to-Clean and Restoration Services
Green-to-clean and restoration services are quoted on a case-by-case basis. We do not guarantee specific results within a specific timeframe; severely neglected pools may require multiple visits, equipment work, and partial drains.
14. Salt Systems
For salt-chlorinated pools, we monitor and add salt as needed. Salt cells require periodic cleaning and eventual replacement; replacement is not included in recurring service.
15. Winterization and Opening
Pool opening and winterization are seasonal services billed separately unless explicitly included in your agreement.
16. Spa Drain and Refill
Spa drain-and-refill is a separate service, typically performed quarterly. Refill water consumption is the customer's responsibility.
Liability, Insurance & Legal
17. Insurance
Ecoast carries commercial general liability insurance. A certificate of insurance is available on request.
18. Limitation of Liability
(a) Maximum Liability. To the maximum extent permitted by law, Ecoast's total liability to you for any claim arising from or relating to these Terms or our services is limited to the amount paid by you to Ecoast in the 12 months preceding the claim.
(b) No Consequential Damages. Ecoast is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or property damage that is not directly caused by our negligence.
(c) No Warranty. Services are provided “as is” except as expressly stated in these Terms or your agreement. We disclaim all implied warranties to the extent permitted by law.
19. Indemnification
You agree to indemnify and hold harmless Ecoast, its officers, employees, and agents from any claim arising from (a) your breach of these Terms, (b) unsafe conditions on your property, (c) misuse of the pool or spa, or (d) failure to follow our written safety guidance.
20. Communications and Consent
(a) Email. By providing your email address, you consent to receive service-related emails (appointment confirmations, invoices, service updates, billing notices, and Terms changes).
(b) SMS. By providing your mobile number, you consent to receive service-related text messages from Ecoast Pool Service, including appointment reminders, schedule changes, job status updates, service completion notifications, billing information, emergency notifications, and responses to your inquiries. You may also provide consent verbally during a recorded phone call with our staff; we will retain the call recording as the record of your consent. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help.
(c) Marketing. Marketing communications (newsletters, promotions) are sent only with separate opt-in. You may opt out at any time using the unsubscribe link.
21. Privacy
Our collection, use, and disclosure of your personal information is governed by our Privacy Policy. Please review it.
22. Modification of Terms
We may update these Terms at any time. Material changes will be communicated by email at least 30 days before they take effect. Continued use of our services after the effective date of an update constitutes acceptance of the updated Terms. The current version is always posted at ecoastpoolservice.com/terms.
23. Governing Law and Dispute Resolution
(a) Governing Law. These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles.
(b) Venue. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Cape May County, New Jersey, and you consent to personal jurisdiction in those courts.
(c) Informal Resolution First. Before filing any action, the parties agree to attempt good-faith resolution by direct negotiation for at least 30 days.
24. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with your signed agreement or accepted quote, constitute the entire agreement between you and Ecoast and supersede any prior agreements or representations on the same subject.
25. Assignment
You may not assign these Terms without our written consent. We may assign these Terms in connection with a sale, merger, or reorganization of our business.
