Acceptance of Terms
By approving this quote and/or submitting payment, whether by check, credit card, bank transfer, or any other method, the client acknowledges acceptance of the terms, pricing, and scope of work outlined above. Any changes to requested services must be confirmed in writing. Payment constitutes full authorization to proceed with the services described, and serves as binding acceptance of this quote in lieu of a physical signature.
1. Contract Term & Auto-Renewal
This Agreement is effective from the date of acceptance through December 31, 2026 (the "Initial Term"). After the Initial Term, this Agreement will automatically renew for successive one-year terms on January 1 of each year unless either party provides written notice of cancellation at least thirty (30) days prior to the renewal date. Upon renewal, all service contracts transition to a standard 12-month billing cycle. Clients will receive email notification of any contract changes, including pricing adjustments, at least thirty (30) days before the renewal date.
2. Pricing & Annual Adjustments
The pricing set forth in this Agreement applies to the Initial Term. Upon renewal, Ecoast Pool Service may adjust pricing with at least thirty (30) days' written notice prior to the renewal date. If the Client does not agree to the adjusted pricing, the Client may cancel the Agreement before the renewal date without penalty. Continued service after the renewal date constitutes acceptance of the updated pricing.
3. Promotional Discounts & Coupon Policy
Ecoast Pool Service may offer promotional discount codes from time to time. The following terms apply to all promotional offers:
- NEWCUST discount: The "NEWCUST" promotional code provides a 5% discount and is available exclusively to first-time customers who have never been billed by Ecoast Pool Service. This code may be used once per customer and once per service property. Returning customers are not eligible.
- Annual payment discount: Customers who elect to pay their full annual contract in a single payment receive an additional 5% discount.
- Maximum combined discount: The total combined discount from all promotional codes, billing incentives, and any other offers shall not exceed 10% of the base contract price under any circumstances.
- Coupon abuse: Ecoast Pool Service reserves the right to revoke any promotional discount, adjust pricing to the standard non-discounted rate, and/or charge the difference retroactively to the card on file if it determines, in its sole discretion, that a promotional code was used fraudulently, applied to an ineligible account or property, or otherwise misused. By accepting these terms, the Client authorizes such adjustments.
4. Payment Terms
Monthly billing begins on the date of sign-up and is structured as follows:
- Year 1 monthly payment: The total contract value is divided by the number of full or partial months remaining from your sign-up date through December 31 of the same calendar year (always rounded up). This means customers who sign up later in the year will have a higher monthly payment in Year 1, because the same contract value is spread over fewer months.
- Example: A customer signing up March 18 with a $3,040 annual contract has 10 months to December 31. Their Year 1 monthly payment is $304. A customer signing up June 1 with the same contract has 7 months remaining, so their Year 1 payment is $435.
- January 1 reset: On January 1 of each renewal year, all contracts automatically reset to 12 equal monthly payments based on the then-current annual price for your service tier. This reset applies to all customers — standard and late sign-ups alike.
- Late sign-ups (customers enrolling during or after opening week) are priced proportionally based on their actual contracted weeks. Opening week is defined as the week before Memorial Day. The minimum closing date for any contract is the day after Labor Day.
- Payment method: A valid credit or debit card must be on file at all times. Cards are charged automatically on the monthly anniversary of your sign-up date. A late fee of $25.00 may apply to payments more than fifteen (15) days past due. Service may be suspended after thirty (30) days of non-payment.
5. Mid-Term Cancellation
Because monthly payments in Year 1 are calculated by dividing the total annual contract value across the remaining months of the calendar year, early cancellation may result in a situation where the total payments made to date are less than the value of services already received.
If you cancel before your contract term ends, the following applies:
- The system will calculate the total remaining balance on your contract (remaining months × your current monthly rate).
- This balance will be automatically charged to your card on file at the time of cancellation. By accepting these terms, you authorize this charge.
- Once the reconciliation charge is processed, your subscription will be cancelled and no further charges will apply.
- If your card on file is declined, your account will be flagged for manual resolution and service may be suspended until the balance is settled.
- If payments made exceed the value of services received at the time of cancellation, a refund of the difference will be issued within thirty (30) days.
This policy exists to protect the integrity of annual service contracts and ensure fair compensation for work already scheduled and performed on your behalf.
6. Quote Validity & Scheduling
This quote is valid until the end of the month in which it is issued, or two business days (Monday–Saturday) before the service schedule or opening is set to begin, whichever comes first. After expiration, pricing and availability may change. Service dates are not guaranteed until the quote is accepted and scheduled. Delayed responses may result in limited availability for originally requested dates.
7. Estimates & Scope Changes
This Agreement is an estimate based on the current condition of the pool/spa, information provided at the time of assessment, and standard service expectations. Final cost may vary depending on actual site conditions, unforeseen complications, or additional service requests. However, price increases will only occur if additional work or materials are required beyond the standard scope, which is not typically expected. Any additional charges will be discussed and approved by the Client before proceeding.
8. Customer Responsibilities
- Ensure clear and safe access to the pool/spa and all required equipment at all times. If access is restricted, service may be rescheduled and a trip fee of up to $50.00 may apply.
- Provide a designated storage area for the winter cover during the service season.
- Maintain the pool's water level and bear all costs associated with water fill or top-off, including municipal water charges.
- Properly store equipment, covers, and accessories during the off-season unless specified otherwise in this Agreement.
- Notify Ecoast Pool Service of any changes to the pool, equipment, or property that may affect service delivery.
- Keep persons, pets, and personal property clear of the pool area during and for a minimum of one (1) hour after chemical treatment, unless otherwise advised by the service technician.
9. Weather & Force Majeure
All work is subject to weather conditions and scheduling availability. Service dates may shift due to inclement weather or other operational factors. Neither party shall be liable for failure to perform obligations under this Agreement due to circumstances beyond their reasonable control, including but not limited to natural disasters, pandemics, government orders or restrictions, supply chain disruptions, labor shortages, acts of God, or utility failures. The affected party shall provide prompt notice and resume performance as soon as reasonably practicable.
10. Equipment & Filtration
Filtration and equipment performance directly impact service outcomes. If equipment failure or inefficiency prevents proper cleaning or water recovery, repairs will be required before treatment can continue. Any necessary repairs, replacement parts, or specialty treatments beyond routine maintenance will be quoted separately and require Client approval before proceeding. Ecoast Pool Service is not responsible for service quality issues caused by malfunctioning or inadequate equipment.
11. Green-to-Clean & Water Recovery
Recovery timelines vary based on water condition, filtration system efficiency, and external factors such as debris, pollen, or heat exposure. Severe cases may require multiple treatments over several visits. If additional services, chemicals, or extended labor are required beyond the standard recovery process, they will be discussed and approved by the Client before implementation.
12. Pool Salt Disclaimer
While Ecoast Pool Service includes all standard chemical adjustments in every phase of service, large-scale salt additions are billed separately due to material volume and delivery constraints. A separate salt charge may apply if: (a) the pool requires 200 pounds or more of salt (five or more 40 lb bags) to reach minimum salinity for the salt chlorine generator; (b) the pool was recently converted to saltwater and has not yet been salted; or (c) salt levels are significantly low due to water replacement, fresh fills, or prolonged neglect. Salt levels can only be accurately assessed after opening and cleanup, so any required additions will be quoted at that time. For salt system conversions completed by Ecoast Pool Service, initial salting is included in the installation cost. For systems installed by others, a separate Salt Application Package will be required.
13. Winterization Disclaimer
Ecoast Pool Service is not responsible for freeze damage resulting from early equipment startup by the Client or others, unforeseen plumbing failures, customer modifications after winterization is completed, or acts of nature. It is the Client's responsibility not to restart any pool equipment after winterization without prior authorization from Ecoast Pool Service.
14. Spa Drain & Refill Services Disclaimer
Drain and refill services apply only to spas, as part of routine water maintenance. Spas will be fully drained, cleaned, and refilled every three to four months or midway through a service contract. Filters will be cleaned, and equipment will be inspected during each drain and refill. One of these scheduled drain and refills, typically the final one of the year, will include a full pipe cleanse to prevent buildup in piping. If a spa is winterized, that will count as one of the scheduled drain and refill services, as performing both would be redundant.
15. Emergency/Unscheduled Spa Drain & Refill Services Disclaimer
Emergency spa drain and refill services due to homeowner or guest misuse — including but not limited to inappropriate chemical additions, overuse or unclean bathers, introduction of soaps, lotions, oils, or foreign substances — are not covered under the standard service agreement. These events may require additional labor, materials, or scheduling adjustments beyond routine service, and an additional fee may be applied. Ecoast Pool Service reserves the right to assess the condition on-site and advise the customer before proceeding.
Liability, Insurance & Legal
16. Limitation of Liability
Ecoast Pool Service's total liability under this Agreement shall not exceed the total amount paid by the Client for services during the current service year. In no event shall Ecoast Pool Service be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, or property damage beyond the pool and its immediate equipment, regardless of the cause of action. This limitation applies to the fullest extent permitted by New Jersey law.
17. Pre-Existing Conditions & Surface Disclaimer
Ecoast Pool Service is not responsible for pre-existing conditions including, but not limited to, cracked or deteriorating plaster, aging tile or coping, stained surfaces, structural defects, or worn equipment. Cleaning, chemical treatment, and normal service may reveal or accentuate pre-existing damage that was not visible prior to service. The Client acknowledges that Ecoast Pool Service is not liable for the appearance or condition of surfaces that were in a degraded state before services began.
18. Insurance
Ecoast Pool Service maintains general liability insurance and workers' compensation coverage as required by New Jersey law. Certificates of insurance are available upon request. The Client is responsible for maintaining adequate homeowner's insurance covering their pool, equipment, and surrounding property.
19. Indemnification
The Client agrees to indemnify, defend, and hold harmless Ecoast Pool Service, its owners, employees, agents, and subcontractors from and against any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) the Client's failure to comply with their obligations under this Agreement; (b) unauthorized modifications to the pool, equipment, or chemical balance by the Client or third parties; (c) injuries or damages resulting from use of the pool by the Client, their family, guests, or tenants; or (d) any inaccurate information provided by the Client.
20. Chemical Exposure & Safety
Pool maintenance involves the use of industrial chemicals that may cause irritation or adverse reactions. The Client is responsible for keeping all persons and pets away from the pool during and immediately after chemical treatment as instructed. Ecoast Pool Service is not liable for injuries, health issues, or property damage resulting from pool use during or after chemical application when the Client has been advised of re-entry times.
21. Property Access & Photo Documentation Consent
By accepting this Agreement, the Client grants Ecoast Pool Service permission to access the pool area and surrounding property as needed to perform services, and consents to the photographing and documenting of the pool, equipment, and service work for internal records, service tracking, and quality assurance purposes. Photographs will not be used for marketing or promotional purposes without separate written consent.
22. Assignment
Ecoast Pool Service may assign this Agreement to a successor, affiliate, or purchaser of substantially all of its assets or business operations. The Client may not assign this Agreement without prior written consent. In the event the Client sells or transfers ownership of the property, this Agreement terminates automatically unless the new owner agrees in writing to assume the Client's obligations. The Client must notify Ecoast Pool Service of any pending sale or transfer at least thirty (30) days in advance.
23. Dispute Resolution & Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey. In the event of any dispute arising under or related to this Agreement, the parties agree to first attempt resolution through good-faith mediation administered by a mutually agreed-upon mediator in Cape May County, New Jersey. If mediation is unsuccessful within sixty (60) days, either party may pursue resolution in the courts of Cape May County, New Jersey. Each party shall bear its own costs and attorney's fees unless otherwise awarded by the Court.
24. Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
25. Entire Agreement
This Agreement, including all exhibits and addenda, constitutes the entire agreement between the parties and supersedes all prior or contemporaneous understandings, whether written or oral. No modification to this Agreement shall be effective unless made in writing and signed by both parties. Any changes to requested services must be confirmed in writing.
